These Terms of Service (“Terms”) govern your access to and use of the CrewBadger platform, operated by JKP Group LLC (“CrewBadger,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms.
1. Accounts and Access
To use CrewBadger you must create an account and provide accurate, current information about your business. You are responsible for safeguarding your login credentials and for any activity that occurs under your account.
You must be at least 18 years old and authorized to bind the business entity on whose behalf you use the Service.
2. The Service
CrewBadger provides a field service management platform including job dispatch, customer communications, invoicing, and related workflows. Certain capabilities (such as SMS messaging, advanced reporting, or payment processing) are offered as paid add-ons under separate subscription terms.
3. Subscription and Billing
CrewBadger subscriptions are billed monthly in advance. Paid add-ons are billed as additional subscription items on the same billing cycle. Fees are non-refundable except as required by law.
You may cancel your subscription at any time from the Settings section of your account. Cancellation takes effect at the end of the current billing period.
Usage-based charges (for example, SMS message overages) are billed monthly in arrears based on the measured usage.
4. Acceptable Use
You agree not to:
- Use the Service to send unsolicited messages, engage in SMS spam, or otherwise violate the Telephone Consumer Protection Act (TCPA), CAN-SPAM, or any other applicable communication law.
- Send messages to recipients who have not provided prior express consent, or to recipients who have opted out via STOP or equivalent keyword.
- Attempt to reverse-engineer, decompile, or access non-public portions of the Service.
- Use the Service to process payments for, or communicate with, customers in connection with unlawful activity.
- Resell, sublicense, or make the Service available to any party that is not your direct employee, contractor, or designated user.
CrewBadger may suspend or terminate accounts that we reasonably believe are in violation of these rules. Carrier compliance violations (for example, A2P 10DLC brand or campaign revocation) may result in immediate suspension of messaging features without prior notice.
5. Customer Data
You retain ownership of the customer information, job history, photos, and other data you submit to the Service (“Customer Data”). You grant CrewBadger a non-exclusive license to process Customer Data solely to provide and improve the Service.
You are responsible for ensuring you have legal authority and appropriate consent from your end customers to collect, store, and communicate with them using CrewBadger, including express consent to receive SMS messages where applicable.
6. SMS Messaging Terms
CrewBadger enables businesses to send transactional SMS messages to their end customers. If you use the SMS features of the Service, the following additional terms apply.
Consent Responsibility
You are solely responsible for obtaining prior express written consent from each recipient before sending SMS messages through CrewBadger, as required by the Telephone Consumer Protection Act (TCPA) and any other applicable federal, state, or local law. CrewBadger provides tools to help you document consent, but the legal obligation to obtain and retain proof of consent rests entirely with you.
Permitted Message Content
SMS messages sent through CrewBadger are limited to transactional and service-related communications, including appointment confirmations, technician dispatch notifications, payment requests, and review invitations. You may not use CrewBadger to send marketing, promotional, or advertising messages unless you have obtained separate express written consent for marketing communications in compliance with applicable law.
Message Frequency and Rates
Recipients may receive up to 5 messages per service appointment. Message and data rates may apply. SMS consent is not a condition of purchasing any goods or services from CrewBadger or from any business that uses CrewBadger.
Opt-Out and HELP
CrewBadger automatically processes opt-out requests. When a recipient replies STOP, CANCEL, UNSUBSCRIBE, END, or QUIT to a message sent through CrewBadger, we will immediately suppress future messages to that number. You must not attempt to circumvent, override, or manually re-enable messaging to any recipient who has opted out. Recipients may reply HELP to receive support information, including a contact phone number or email address.
Carrier Compliance
You must register for A2P 10DLC through CrewBadger and provide accurate, complete information about your business during registration. Misrepresentation of your business identity, use case, or message content during carrier registration may result in immediate termination of your messaging capabilities and, at our discretion, your account. CrewBadger reserves the right to suspend SMS features without prior notice if a carrier revokes your brand or campaign registration.
No Guarantee of Delivery
SMS delivery depends on mobile carriers, network conditions, and recipient device settings. CrewBadger does not guarantee that any message will be delivered, received, or read. Carrier filtering, network congestion, and other factors outside our control may prevent or delay delivery.
7. AI-Powered Features
CrewBadger uses artificial intelligence to generate content such as proposal summaries, service descriptions, business insights, and other text (“AI Content”). The following terms apply to your use of AI-powered features.
AI Content Is a Starting Point
AI Content is generated as a draft to assist you. It is your responsibility to review, edit, and approve all AI Content before sharing it with customers, including it in proposals, or relying on it for business decisions. AI Content may contain inaccuracies, incomplete information, or inappropriate suggestions. It does not constitute professional, legal, financial, or technical advice.
Your Responsibility for Approved Content
Once you review and approve AI Content — whether by sending a proposal, publishing a description, or otherwise distributing it — that content becomes yours. CrewBadger is not liable for errors, omissions, or misrepresentations in AI Content that you have reviewed, approved, and distributed to third parties.
Consent to AI Processing
By using AI-powered features, you consent to CrewBadger processing your Customer Data through AI models to generate AI Content. All such processing is subject to our Privacy Policy.
Model Improvement
We may use de-identified and aggregated data derived from your use of AI features to improve model performance and the quality of AI Content across the platform. No personally identifiable Customer Data is shared with third-party model providers for training purposes without your consent. If you wish to opt out of model improvement using your de-identified data, contact us at hello@crewbadger.com.
8. Third-Party Services
CrewBadger integrates with third-party services (including Stripe for payments, Twilio for SMS, Resend for email, and Google for maps and calendar features). Your use of integrated features is subject to the respective third party’s terms. CrewBadger is not responsible for third-party outages, pricing changes, or policy changes.
9. Warranties and Disclaimer
CrewBadger is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or that any messages, calls, or payments will be delivered, received, or processed on any specific timeline.
10. Limitation of Liability
To the fullest extent permitted by law, JKP Group LLC and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of revenue, profits, data, or goodwill, even if advised of the possibility of such damages. Our aggregate liability for any claim arising out of these Terms is limited to the amounts paid by you to CrewBadger in the twelve months preceding the event giving rise to the claim.
11. Indemnification
You will indemnify and hold harmless JKP Group LLC and its affiliates from any claims, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your Customer Data, or your violation of these Terms, applicable law, or the rights of any third party — including without limitation claims brought under the TCPA or similar communication statutes.
12. Termination
Either party may terminate your account at any time. Upon termination, your right to access the Service ends. We will make Customer Data available for export for a reasonable period after termination, after which we may delete it in accordance with our data retention policies.
13. Governing Law
These Terms are governed by the laws of the Commonwealth of Puerto Rico and the United States, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in Puerto Rico, unless otherwise required by applicable law.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service prior to the changes taking effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
